Privacy Policy

This Privacy Policy explains how Bauer Investments (International) Pty Ltd (ACN 160 003 510, ABN 24 160 003 510) trading as Dealer Exchange(we, us, our) handles personal information in connection with the DealerExchange platform (the Platform).

We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). The Platform is a business-to-business marketplace for licensed motor dealers; most of the information we hold relates to dealerships and the individuals who act on their behalf.

1.Information we collect

We collect personal information directly from you when you register, update your profile, and trade on the Platform. This includes:

  • Identity and contact details — your name, role, dealership name, business address, email, phone number, and (if provided) accounts-team contact details;
  • Verification information — your motor dealer licence number and a copy of the licence document, your ABN, and state of operation;
  • Account credentials — your email and a hashed password (we do not store passwords in readable form);
  • Trading activity — listings you create, bids and offers you submit, vehicles you purchase or sell, internal notes, and messages exchanged on the Platform;
  • Billing information — invoice contacts, GST status, and payment records relating to commission fees;
  • Technical information — IP address, device and browser information, and pages visited, collected automatically by our hosting and error-monitoring providers.

2.How we use your information

We use personal information to:

  • verify your identity and dealer-licence status, and approve your account for trading;
  • operate the Platform — show listings, route bids and offers, and process completed trades;
  • issue tax invoices and statements, and recover unpaid fees;
  • communicate with you about your account, trades, security, and changes to the service;
  • investigate suspected breaches of our Terms, fraud, or unlawful conduct;
  • improve and secure the Platform, including by analysing error reports and usage patterns;
  • comply with our legal and regulatory obligations, including record-keeping under tax and motor-dealer law.

3.When we disclose your information

We disclose personal information only as needed to run the service. Recipients include:

  • Other dealers on the Platform — your dealership name, suburb, and state are visible alongside listings, bids and offers. Direct contact details (phone and email) are revealed only after a sale completes and only to the counter-party of that trade.
  • Service providers we rely on — including Supabase (database and authentication), Resend (transactional email), Sentry (error monitoring), Stripe (subscription billing), and Netlify (hosting). These providers process information on our behalf under contract and only for the purposes described in this Policy.
  • Professional advisers — our accountants, auditors and lawyers, where relevant to a specific engagement.
  • Regulators and law enforcement — where we are required or authorised by law to do so, or to investigate suspected breaches of motor-dealer or consumer law.
  • A purchaser of our business — in the event of a sale or restructure, to the extent necessary for due diligence and to give effect to the transaction.

We do not sell personal information.

4.Overseas storage and disclosure

Some of our service providers store data outside Australia. In particular, Supabase and Sentry may host data in the European Union, and Resend processes email through providers in the United States. Where personal information is disclosed overseas, we take reasonable steps to ensure that the recipient handles it in a way that is consistent with the APPs.

5.Security and retention

We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, and disclosure — including encryption in transit, role-based access controls, and audit logging of sensitive admin actions. No system is perfectly secure, and we cannot guarantee absolute security.

We retain personal information for as long as needed to provide the service and to meet our legal obligations. Trade records, invoices and other accounting data are kept for at least seven (7) years, as required by Australian tax law. When information is no longer required, we delete or de-identify it.

6.Cookies and analytics

We use a small number of essential cookies and similar technologies to keep you signed in, remember your session, and operate the Platform securely. Our hosting and error-monitoring providers may set additional cookies for performance and reliability purposes. You can control cookies through your browser settings; disabling essential cookies will prevent you from signing in.

7.Access, correction and your rights

You can view and update most of your account and dealership details directly from your profile page in the Platform. If you need access to other personal information we hold about you, or if any information is inaccurate, please contact us using the details at the end of this Policy. We may need to verify your identity before responding to a request.

You can also unsubscribe from non-essential email communications at any time. We will still send you operational messages relating to your account and trades (such as bid notifications and invoices) while your account is active.

8.Data breach notification

We comply with the Notifiable Data Breaches scheme under the Privacy Act. If we become aware of a data breach that is likely to result in serious harm to affected individuals, we will notify you and the Office of the Australian Information Commissioner (OAIC) as soon as practicable.

9.No use by minors

The Platform is intended only for licensed motor dealers and the staff they authorise. We do not knowingly collect personal information from anyone under 18.

10.Changes to this Policy

We may update this Policy from time to time. The effective date at the top of this page shows when it was last revised. If we make a material change, we will tell you through the Platform or by email.

11.Complaints and contact

If you have a question or complaint about how we have handled your personal information, please contact us first and we will investigate and respond within a reasonable time.
